Terms of Service

1. Agreement to terms

These Terms of Service ("Terms") constitute a legally binding agreement between SJSR Labs ("Company", "we", "us", or "our") and each person or organization ("User", "you", or "your") accessing or using the Softball-League website, tenant league pages, team portals, APIs, and the Softball League Broadcast applications for iOS and Android (collectively, the "Service").

By accessing, browsing, registering for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.

2. Role of SJSR Labs (Software provider only)

SJSR Labs is exclusively a software-as-a-service technology provider. The Service provides tools for athletic league scheduling, digital scorekeeping, automated box scores, team communication, live camera streaming, and video replay archiving.

Each participating league, tournament, or sports organization ("League Organizer") is an autonomous entity that operates independently. SJSR Labs does not own, direct, or operate any participating league, and does not control:

• Physical softball fields, ballparks, dugouts, bleachers, or athletic facilities;
• Equipment safety, condition, or compliance (such as bats, balls, helmets, or catchers' gear);
• Weather-related game decisions, rainouts, lightning delays, or heat index protocols;
• The qualifications, physical fitness, or background checks of coaches, umpires, or staff;
• The resolution of on-field protests, umpire calls, ejections, or rule disputes.

3. Athletic risk assumption and liability waiver

Inherent hazards: You acknowledge that participation in softball, baseball, and related athletic activities involves inherent, unavoidable risks of serious bodily injury, illness, concussion, permanent disability, and death. These hazards include being struck by pitched, batted, or thrown softballs; contact with swinging, thrown, or broken bats; collisions with other players, fences, light poles, or backstops; slips and falls on irregular terrain; and heat illness or adverse weather.

Voluntary assumption: TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU KNOWINGLY, FREELY, AND VOLUNTARILY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, ASSOCIATED WITH PARTICIPATING IN, COACHING, OFFICIATING, SCOREKEEPING, OR ATTENDING ANY GAME, PRACTICE, OR EVENT ADMINISTERED OR TRACKED THROUGH THE SERVICE.

Release of SJSR Labs: YOU HEREBY FULLY RELEASE, WAIVE, AND FOREVER DISCHARGE SJSR LABS, ITS OFFICERS, EMPLOYEES, AND AGENTS FROM ANY AND ALL CLAIMS, DEMANDS, LIABILITIES, OR LAWSUITS ARISING FROM PERSONAL INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE OCCURRING IN CONNECTION WITH ANY ATHLETIC ACTIVITY, WHETHER ARISING FROM ORDINARY NEGLIGENCE OR OTHERWISE.

4. Accounts, eligibility, and minor participants

Age requirement: You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to establish an administrator, manager, coach, official, or independent player account.

Minors: If a player is under 18 years of age, their registration, account profile, and digital waiver acceptance must be executed by their parent or legal guardian. The parent or legal guardian expressly agrees to these Terms and executes all liability waivers and media likeness releases on behalf of the minor.

Account security: You are responsible for safeguarding your credentials, passwords, passkeys, and authentication tokens. You agree to notify us immediately of any unauthorized access to your account.

5. Live streaming, video archives, and media likeness release

Broadcast features: The Service provides tools for authorized broadcasters, coaches, and scorekeepers to stream live video and audio from athletic venues, record games, generate highlight clips, and archive full games.

Likeness release: By participating in any game, event, or league administered through or broadcast on the Service, you grant to SJSR Labs, the League Organizer, and their designees a perpetual, worldwide, royalty-free license to record, stream, display, reproduce, and distribute your name, likeness, jersey number, voice, image, and athletic statistics across league websites, mobile applications, live video streams, replay archives, and highlight clips without compensation. Parents and legal guardians grant this release on behalf of minor participants.

Ambient music warning: Field loudspeakers and walk-up songs frequently play commercial music. Broadcasters must not deliberately stream copyrighted audio without proper licenses. Third-party video services (such as YouTube) may automatically mute, restrict, or flag streams containing copyrighted background music. SJSR Labs is not liable for stream disruptions or mutes caused by music rights detection.

6. Third-party integrations and YouTube API terms

League administrators may optionally connect a league-owned YouTube channel to archive live broadcasts or host game replays.

By using YouTube-connected features within the Service, you expressly agree to be bound by the YouTube Terms of Service and the Google Privacy Policy. Authorized administrators may disconnect their YouTube channel at any time in league settings or revoke access through the Google Security Settings.

7. Acceptable use and community standards

You agree to use the Service only for lawful, sports-related purposes and in full compliance with our Community Standards. You agree not to:

• Transmit threats of violence, intimidation, stalking, harassment, or defamation;
• Post hate speech targeting race, ethnicity, religion, disability, gender, gender identity, or sexual orientation;
• Upload or stream sexually explicit material, obscenity, or content that endangers minors;
• Impersonate any player, coach, official, or administrator, or falsify eligibility records;
• Attempt to compromise system security, probe vulnerabilities, or inject malicious code;
• Scrape, harvest, or export participant contact lists without explicit authorization.

Team chat messages are subject to automated filtering and administrator moderation. SJSR Labs and League Organizers reserve the right to mute, suspend, or terminate accounts that violate these rules.

8. Copyright policy and DMCA takedown notice

We respect intellectual property rights. If you believe that content hosted on the Service infringes your copyright, submit a written takedown notice to our Designated Copyright Agent:

Your notice must satisfy all requirements of 17 U.S.C. § 512(c)(3), including: identification of the copyrighted work; identification and URL of the infringing material; your contact details; a good-faith statement that use is unauthorized; and a statement under penalty of perjury that the notice is accurate and that you are authorized to act on behalf of the owner.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

SJSR LABS DOES NOT WARRANT THAT LIVE BROADCASTS WILL BE DELAY-FREE OR UNINTERRUPTED UNDER OUTDOOR FIELD CONDITIONS, THAT BOX SCORES OR STATISTICS WILL BE ERROR-FREE, OR THAT THE SERVICE WILL OPERATE WITHOUT HARDWARE OR NETWORK INCOMPATIBILITIES.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• No indirect damages: IN NO EVENT SHALL SJSR LABS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR INCIDENTAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.
• No athletic injury liability: SJSR LABS SHALL NOT BE LIABLE FOR ANY BODILY INJURY, ILLNESS, DISABILITY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF ATHLETIC PARTICIPATION, UNSPORTSMANLIKE CONDUCT, FACILITY CONDITIONS, OR WEATHER.
• Monetary liability cap: IN ALL CIRCUMSTANCES, SJSR LABS' TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE SERVICE SHALL BE LIMITED TO THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO SJSR LABS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS ($100.00 USD).

11. Indemnification

You agree to defend, indemnify, and hold harmless SJSR Labs, its officers, directors, employees, and agents against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms or the Community Standards; (c) your User Content or live broadcasts (including copyright claims over streamed music); (d) your conduct at any athletic venue or game; or (e) any dispute between you and a league organizer, coach, player, or umpire.

12. Dispute resolution and binding individual arbitration

Informal resolution first: Before filing any formal claim, you agree to contact us at [email protected] and attempt in good faith to resolve the matter informally for at least thirty (30) days.

Arbitration: Any dispute that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class action waiver: YOU AND SJSR LABS AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
